Talker.com Acceptable Use Policy

Agreement made on __________  ___  ____, between Talker.com

and ____________________________, (the "Customer").

1. The term "Customer" shall refer to Customer, Customer’s officers, agents or contractors and to Customer’s designated users. "Community" refers to the world wide Internet community. "Network" refers to any and all physical components of hardware or links between other hardware comprising talker.com and it’s connection to other networks, including the Internet.
2. The Customer may make any lawful use of the network and the information, software, or other content received through it. The Customer may not transmit any material in violation of any international, federal, state or local law or regulation. Customer specifically acknowledges that the transmission and exportation from the United States of technical date is subject to compliance with the U.S. Export Administration Act of 1979, as amended, the Arms Export Control Act of 1976, as amended and numerous other rules laws and regulations which restrict the export of software, technical data, documentation and products.
3. Indemnification’s: Customer acknowledges that it is solely the responsible for the contents of its transmissions over the network. Customer agrees to indemnify and hold harmless Talker.com from any claims, costs or damages resulting from it unauthorized, illegal or improper transmission of data in violation of and local, state federal or international laws or regulations.
4. Customer agrees not to interfere with or disrupt other network users, services or equipment. Disruptions included, but are not limited to, distribution of unsolicited advertising, propagation of computer worms and viruses, using the network to make unauthorized entry to any machine accessible via the network.
5. Customer agrees to act in good faith and to respect the conventions of the Internet Community and the news groups, lists, networks, sites and services accessed.
6. Talker.com may disconnect customer at any time without prior notice if in its opinion the network is being used in a way harmful to Talker.com or any other members of the Internet Community. Talker.com shall also have all other remedies available at law. Customer’s sole remedy for improper disconnection is a refund of any advance payments made.
7. Customer agrees not to store, transmit or distribute pornography on or through the network in any form, including, but not limited to, images, writings or multimedia in either compressed, encoded or any other format.
8. Customer agrees to any and all amendments to this acceptable use policy as made by Talker.com. Any and all updates to this agreement will be posted at the URL http://www.talker.com/aup.htm This location is subject to password protection by talker.com so that it is viewable only to customers of Talker.com.
